1. Introduction and Acceptance
These Terms and Conditions ("Terms") govern your use of the website paradoxh2o.com ("Website") and services provided by Paradox Water Delivery ("Company," "we," "us," or "our"), a bulk potable water delivery company operating in the Texas Hill Country region.
By accessing our Website, submitting a contact form, requesting a quote, or scheduling water delivery services, you agree to be bound by these Terms. If you do not agree, please do not use our Website or services.
2. Services Provided
2.1 Description of Services
Paradox Water Delivery provides bulk potable water delivery via truck to residential and commercial properties in the Texas Hill Country area. Our services are designed for properties without municipal water access, including rural homes, new construction sites, rainwater collection system refills, cistern and tank fills, swimming pools, and temporary water needs.
2.2 Service Area
Our service area is limited to the Texas Hill Country region. Service availability depends on road accessibility, delivery logistics, and current demand. We reserve the right to decline service to locations outside our designated service area or to properties with inaccessible conditions. Please contact us to confirm service availability for your specific location.
2.3 Water Quality
We deliver potable water sourced from municipal water supplies or other sources that meet applicable Texas Commission on Environmental Quality (TCEQ) standards for drinking water. Water quality may vary based on the source. We do not guarantee that delivered water will meet specific customer requirements beyond applicable regulatory standards. Customers with unique water quality needs should conduct independent testing.
3. Scheduling and Delivery
3.1 Requesting Service
To request water delivery, customers may submit an inquiry through our Website contact form, call us directly, or use other communication methods we may offer. Submission of a request does not guarantee service. Delivery scheduling is subject to availability and confirmation by our team.
3.2 Scheduling and Confirmation
Delivery dates and times are estimates and subject to change based on weather, road conditions, equipment availability, and operational constraints. We will make reasonable efforts to notify you of any changes to your scheduled delivery. A confirmed delivery requires mutual agreement on date, time window, location, and pricing.
3.3 Cancellation and Rescheduling
Customers may cancel or reschedule a delivery by contacting us at least 24 hours before the scheduled delivery time. Cancellations made with less notice may be subject to a cancellation fee. We reserve the right to cancel or reschedule deliveries due to weather conditions, safety concerns, equipment issues, or other operational needs without penalty.
3.4 Property Access Requirements
The customer is responsible for ensuring our delivery vehicle has safe, legal access to the delivery point. This includes ensuring adequate road width, clearance for our trucks, gate codes or access instructions, and a clear path to the fill point. Delivery may be refused or additional charges may apply if access conditions are unsafe, impassable, or materially different from what was communicated during scheduling.
4. Pricing and Payment
4.1 Pricing
Pricing for water delivery is provided on a per-delivery or per-gallon basis and may vary based on delivery location, volume, and current conditions. All pricing will be communicated and agreed upon before service is rendered. Prices are subject to change without notice for future orders. Quotes are valid for 14 days unless otherwise stated.
4.2 Payment Terms
Payment is due upon receipt of invoice unless otherwise agreed in writing. We accept cash, check, and credit card. Late payments may incur interest charges or result in service suspension for future deliveries.
4.3 Taxes
All prices are exclusive of applicable taxes unless otherwise stated. Customer is responsible for any sales tax, use tax, or other taxes applicable to the transaction under Texas law.
5. Customer Responsibilities
Customers agree to: (a) Provide accurate contact information and delivery address; (b) Ensure safe and accessible conditions for delivery vehicles; (c) Be present or have an authorized representative present at the time of delivery, if required; (d) Inspect their receiving tanks, cisterns, or containers to ensure they are clean, functional, and suitable for potable water; (e) Promptly notify us of any issues with delivery or water quality; and (f) Ensure that all plumbing, tanks, and receiving equipment comply with applicable regulations.
6. Limitation of Liability
6.1 General Limitation
TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, PARADOX WATER DELIVERY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO OUR SERVICES, INCLUDING BUT NOT LIMITED TO PROPERTY DAMAGE, LOST PROFITS, BUSINESS INTERRUPTION, OR WATER CONTAMINATION OCCURRING AFTER DELIVERY.
6.2 Property and Access
We exercise reasonable care when accessing customer property. However, we are not liable for damage to driveways, roads, landscaping, or other property features that occurs as a result of routine delivery operations unless caused by gross negligence. Customers assume responsibility for ensuring their property can accommodate delivery vehicles.
6.3 Water Quality After Delivery
Our responsibility for water quality ends upon delivery to the customer's tank, cistern, or designated receiving point. We are not responsible for contamination, quality degradation, or issues that arise from the customer's storage systems, plumbing, treatment equipment, or post-delivery handling.
6.4 Maximum Liability
In no event shall our total liability to any customer exceed the amount paid for the specific delivery giving rise to the claim.
7. Force Majeure
We shall not be liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to: severe weather, natural disasters, drought restrictions, government-mandated water use limitations, road closures, supply shortages, equipment failures, accidents, labor disputes, acts of terrorism, pandemics, or other emergency situations. In such events, we will make reasonable efforts to notify affected customers and reschedule deliveries when conditions permit.
8. Indemnification
You agree to indemnify, defend, and hold harmless Paradox Water Delivery, its owners, employees, contractors, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising out of or related to: (a) your use of our services; (b) your breach of these Terms; (c) your negligence or misconduct; (d) conditions on your property; or (e) your violation of any applicable laws.
9. Dispute Resolution
9.1 Informal Resolution
Before initiating any formal dispute proceeding, you agree to first contact us directly to attempt to resolve any dispute informally. We will work in good faith to address your concerns.
9.2 Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or our services that cannot be resolved informally shall be resolved by binding arbitration administered in accordance with the Texas Arbitration Act. The arbitration shall be conducted by a single arbitrator in Hays County, Texas. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction. Each party shall bear its own costs and attorney fees unless the arbitrator determines otherwise. BY AGREEING TO THESE TERMS, YOU ARE WAIVING YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.
9.3 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.

All content on our Website, including text, graphics, logos, images, and software, is the property of Paradox Water Delivery or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.
